In these Terms & Conditions ROOM TEMPERATURE Limited (a registered in England & Wales with company number 574 94 15) will be referred to as ‘ROOM TEMPERATURE ‘and the person ordering the products or services will be referred to as ‘the client or customer.

All the terms of the contract between the client or customer and ROOM TEMPERATURE are contained in this document and written specifications provided to the client or customer by ROOM TEMPERATURE on the website or an official quotation No variation of the terms shall bind either party unless such variation is made in writing and signed by the party to be bound.

We try to keep information on the ROOM TEMPERATURE website and in marketing materials relevant and up to date. However, such information should be used as a guide only because products and services are frequently updated and changed.

Any reviews or comments made by members of the public on the ROOM TEMPERATURE website are their opinions only and do not form any part of the specification or advice given by ROOM TEMPERATURE about products or services we supply.

Whilst every effort is made to ensure the installation timescales agreed during the ordering process are met, ROOM TEMPERATURE reserves the right to delay installation for reasons including (for example) fires, strikes, illness, severe weather, lockouts, lockdown terrorism, war and any other causes beyond the control. Of ROOM TEMPERATURE with its execution or completion of the contract. Time shall not be deemed to be the essence of the Contract.

All quotations are valid for 30 days from the date of quotation.

Communication

All communication between the client or customer and ROOM TEMPERATURE will be by email, The client or customer’s email address used by ROOM TEMPERATURE will be the same one supplied by the client or customer during the ordering process.

When the customer places an order via the ROOM TEMPERATURE website, ROOM TEMPERATURE will send the client or customer an email acknowledging the order.

upon physical inspection of the site, it is determined that more equipment such as scaffolding or a significant amount of extra work is required such as asbestos testing or removal, then ROOM TEMPERATURE will inform the client or customer of any increase in costs prior to these being incurred. The customer or client will also be informed of any costs that may be incurred to the installation

ROOM TEMPERATURE reserves the right to decline any order at any time up until completion. Should ROOM TEMPERATURE decline an order, no damages or expenses of any kind whatsoever shall be payable by ROOM TEMPERATURE to the customer or client beyond the refund of any money already paid in relation to the contract.

Any changes in materials or specifications from those detailed in the contract will only apply when supported by an Amendment document issued by ROOM TEMPERATURE, which must be approved by the client or customer (this approval may be carried out either by physical documentation or by email).

All works will be carried out in single phase of work. Work will be carried out on normal working hours.

The above guide that installation work can be carried out continuously on a clear site working condition between 8.30 am to 4.30 pm Monday to Friday, any other time will be additional rates charged. If installation is delayed, suspended or hindered we reserve the right to claim costs incurred by us and to extend the period for completion of installation work. Should the commencement to the work be delayed by the client or customer once the programme is agreed a minimum 2 weeks’ notice is required, failing which it may be necessary to present additional charges to cover the cost of such delays, Not considered on payment delays, or site dispute from any other issue or reason.

Delivery

Whilst every effort is made to ensure the delivery and installation timescales agreed during the ordering process are met, ROOM TEMPERATURE reserves the right to delay installation for reasons including (for example) fires, strikes, illness, severe weather, lockouts, lockdowns’ terrorism, war and any other causes beyond the control of ROOM TEMPERATURE with its execution or completion of the contract. Time shall not be deemed to be the essence of the Contract.

We would anticipate commencing delivery of materials for the works for the site within one week of your acceptance and deposit due

ROOM TEMPERATURE works hard to ensure the delivery of goods are on time, and that the client or customer accepts that at sometimes delivery issues can occur, and this does not give automatic cause for cancellation.

The client or customer is responsible for notifying ROOM TEMPERATURE of any local restrictions that could impact the delivery of goods, for example local parking restrictions, steep stair climbs, stair climbs longer than 20 steps, on foot carrying distances greater than 30 meters.

The client or customer agrees to have someone present at the property for when goods are scheduled to be delivered.

Delivery and installation will be agreed with you following the acceptance of your instruction to proceed but as a general guide based on our current commitments

The client or customer is responsible for keeping any equipment secure and dry once delivered. If equipment is damaged, removed or packaging opened then the client or customer will be liable for any costs or losses incurred.

Installation

During the installation, the client or customer agrees to provide a safe workplace for any persons working on the installation

The client or customer is to provide free access to and from the installation Both internal and external and all related areas related to the installation.

Exclusions

Whilst all reasonable care will be taken by, ROOM TEMPERATURE accepts no liability for any damage to existing plasterwork, decorations, flooring walls, and ceilings etc, cuts, or holes made to allow for equipment will normally be made good but not permanently finished or re-decorated.  Whilst all reasonable care will be taken by, ROOM TEMPERATURE engineers take reasonable care not to damage existing wiring or plumbing or other services at the client or customer property,             

ROOM TEMPERATURE cannot be held responsible for any consequent damage to existing services concealed in walls floors ceilings etc that are not visible.

Job completion

On completion the installation and all the systems will be fully operational tested and commissioned by ROOM TEMPERATURE-approved engineers and necessary drawings and Maintenance and operations manuals will be left on site for your information, together with a maintenance contract.

Warranty 

parts and labour should be under the maintenance contract which all suppliers’ terms and conditions as a part of the equipment

Maintenance contract to be completed within three months of a completed installation

the warranty is subject to the following

  1. Maintenance contract agreed with ROOM TEMPERATURE
  2. If, however, for some reason other service company is employed, proof of recommended maintenance is required with all documents. If any alterations or modifications by others this must comply with ROOM TEMPERATURE maintenance procedure. Otherwise, the warranty will be null and void ROOM TEMPERATURE will not hold any responsibilities whatsoever

Payments

Invoice will be rendered for the following

the project to proceed on official confirmation order

50% on acceptance for the installation to proceed on an official confirmation order.

This allows us to organize the delivery of first fixed materials and reserve equipment with the supplier

40% will be invoiced and due for payment

For the delivery of materials on site.

10% will be invoiced on completion

On completion, a final payment is to be made immediately

Good supplied by ROOM TEMPERATURE will remain the property of ROOM TEMPERATURE until full payment is received

All payments must be made in UK pounds sterling

VAT will be added where applicable

Payment must be made within 7 days of completion, or a 5% interest will be charged

If the client/customer chooses to pay in full at the time of the order
